By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use ListForge.

You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using ListForge on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

ListForge is a Software-as-a-Service (SaaS) platform that provides AI-powered tools for product research, pricing analysis, and marketplace listing creation. Our services include:

• AI-driven product identification and research
• Automated pricing recommendations based on market data
• Multi-marketplace listing generation and management
• Integration with third-party marketplaces (eBay, Amazon, etc.)
• Mobile applications for item capture and management
• Analytics and performance tracking

To use ListForge, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

ListForge offers various subscription plans with different features and pricing. By subscribing, you agree to pay the applicable fees and authorize us to charge your payment method on a recurring basis.

• Subscription fees are billed in advance on a monthly or annual basis
• Refunds are handled in accordance with our refund policy
• We may change pricing with 30 days' notice

You retain ownership of all content you upload to ListForge. By uploading content, you grant us a limited license to use, process, and display your content as necessary to provide the Service.

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious content or attempt to compromise our systems
• Use the Service for fraudulent purposes
• Interfere with other users' access to the Service

ListForge and its licensors retain all rights to the Service, including all intellectual property rights. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

The Service integrates with third-party marketplaces and services. Your use of these integrations is subject to the terms and policies of those third parties. We are not responsible for third-party services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

You agree to indemnify and hold harmless ListForge from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Either party may terminate this agreement at any time. We may suspend or terminate your access immediately for violations of these Terms. Upon termination, your right to use the Service ceases immediately.

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
